DESMA Center Attends Regular Meetings of the Working Group on Legal Analysis and Evaluation related to DKI Jakarta Provincial Law No. 6 of 2015 concerning Tourism

DESMA Center as a member of the Working Group for Legal Analysis and Evaluation related to DKI Jakarta Provincial Regulation Number 6 of 2015 concerning Tourism was also present at the regular meeting of discussions on July 22, 2022. This meeting was held at the Regional Office of the Ministry of Law and Human Rights (Kemenkumham) DKI Jakarta. The meeting was opened by the Head of Legal Affairs (Alfik Abdullah) and was attended by other members of the Working Group, namely the Main Expert Researcher of the National Innovation research section (Dr. Rachmat Trijono, SH., MH), Head of the Tourism and Creative Economy Sub-Service (Dra. Emdrati Fariani, MM), Head of the Legislation Section of the Legal Bureau of the DKI Jakarta Regional Secretariat (Nur Fajar, SH. Msi), Experts of the Tourism and Creative Economy Service (M. Faiz Aziz), JFT Drafting Laws and Regulations, JFT Legal Analysts, and JFU in the Sub-Division of Facilitation of Regional Legal Product Formation.
This meeting presented speakers from the Investment and One-Stop Integrated Services Office, Rintanto. In his presentation, he conveyed various things that need to be considered in this PERDA analysis and evaluation activity, namely about changing the licensing paradigm to risk-based business licensing with a number of new policy and regulatory indicators, moving the country's capital, encouraging sustainable tourism and increasing competitiveness.
DESMA Center on this occasion also explained some of the problems of tourism development in Jakarta such as the lack of optimal integrated governance system, the ineffectiveness of business permit regulations, duplication of land status and the lack of synergistic coordination and authority in supervision between BKPM / Ministry of Investment or DPMPTSP DKI Jakarta.

This meeting activity is expected to help the working group to capture important issues related to licensing in the implementation of tourism business that have an effect in future arrangement.
The results of legal analysis and evaluation activities related to DKI Jakarta Provincial Regulation Number 6 of 2015 concerning Tourism are in the form of recommendations on the status of existing laws and regulations, whether they need to: (1) improvement (revision); (2) reimbursement (repeal); or (3) maintained in order to effectively implement this Bylaw.

In order to carry out regional legal analysis and evaluation activities for fiscal year 2022, the Regional Office of the Ministry of Law and Human Rights of DKI Jakarta has established a Working Group on Legal Analysis and Evaluation regarding DKI Jakarta Regional Regulation Number 6 of 2015 concerning Tourism. DESMA Center is part of the working group.
The House of Representatives of the Republic of Indonesia passed Law Number 11 of 2020 concerning Job Creation on October 5, 2020, which was subsequently promulgated on November 2, 2020. The Job Creation Law is the first legal product in Indonesia with the concept of Omnibus Law. The logical consequence with the promulgation of the Job Creation Law is the establishment of implementing regulations that will spell out further provisions regarding the regulated substance.
This will certainly change the laws and regulations at the local regulatory level. Apart from the impact of the Job Creation Law, there are several provisions in Regional Regulation Number 6 of 2015 concerning Tourism that are no longer relevant. Ideally, the plan for the preparation of draft regional regulations affected by the existence of the Job Creation Law is prepared by paying more attention to the characteristics of regional specificities, in this case DKI Jakarta Province.
