Working Group Meeting on Analysis and Evaluation of the DKI Jakarta Provincial Tourism Regional Regulations with the DKI Jakarta Regional Office of the Ministry of Law and Human Rights

DESMA Center present at Working Group Meeting on Legal Analysis and Evaluation of DKI Jakarta Provincial Regulations about Tourism at the Regional Office of the Ministry of Law and Human Rights DKI Jakarta, held on Tuesday, June 28, 2022. This activity is a follow-up to a series of activities that have been carried out.
After the Omnibus Law, the Regional Office of the Ministry of Law and Human Rights (Kanwil Kemenkumham) DKI Jakarta through the Sub-Sector of Facilitating the Formation of Regional Legal Products carried out the analysis and evaluation of the DKI Jakarta Provincial Tourism Regulation by establishing a Working Group. Also present were representatives of the National Legal Development Agency (BPHN), representatives of BRIN, the DKI Jakarta Provincial Legal Bureau, the DKI Jakarta Tourism and Creative Economy Office, DESMA Center, JFT Legal Analyst and JFT Drafting Legislation Kemenkumham DKI Jakarta Regional Office.
The activity was opened by the Head of Legal Affairs, Mr. Alfik Abdullah and accompanied by the Head of the Sub-Division of Facilitating the Establishment of Regional Legal Products, Mrs. Erinawita. The agenda for the meeting was also listening to the speaker's presentation by Afdhal Mahatta, SH, MH, the Coordinator of Experts for Commission III of the Indonesian House of Representatives. The discussion activity was led by Ms. Erinawita, Head of the Sub-Division of Facilitating the Formation of Regional Legal Products.
On this occasion, DESMA Center exposes an inventory of problems from the initial findings for analysis and evaluation of the legal regulations of the DKI Jakarta Province regarding Tourism. DESMA Center's presentation was given a response from the Expert Coordinator of Commission III of the Indonesian House of Representatives and the chairman of the Working Group to be considered in the follow-up discussions to be carried out.

In the context of implementing the Regional Regulation Analysis and Evaluation activity for the 2022 Fiscal Year, The Regional Office of the Ministry of Law and Human Rights DKI Jakarta has established a Legal Analysis and Evaluation Working Group on DKI Jakarta Regional Regulations Number 6 of 2015 concerning Tourism. DESMA Center is part of the working group.
The Indonesian House of Representatives passed Law Number 11 of 2020 concerning Job Creation on October 5, 2020, which was subsequently promulgated on November 2, 2020. The Job Creation Law is the first legal product in Indonesia with the concept of the Omnibus Law. A logical consequence of the promulgation of the Job Creation Law is the establishment of implementing regulations that will outline further provisions regarding the substance being regulated.
This will of course change the laws and regulations at the regional regulation level. Apart from the impact of the Job Creation Law, there are several provisions in Regional Regulation Number 6 of 2015 concerning Tourism that are no longer relevant. Ideally, the plan for drafting regional regulations that are affected by the existence of the Job Creation Law is prepared with more attention to the characteristics of regional specificities, in this case the DKI Jakarta Province.
